Who you are dealing with

This site, vyreenergy.com, and the VYRE brand are operated by VYBE Energy Drinks LLC, a Florida limited liability company. When these terms say “VYRE,” “we,” or “us,” that is who they mean. Questions go to olivercowin@vyreenergy.com.

By using the site, placing an order, or applying to the ambassador program, you agree to these terms and to our privacy policy. If you do not agree, please do not use the site.

Using the site

• You must be at least 18 to place an order or apply as an ambassador.
• The site is for personal use. Do not scrape it, probe it, overload it, or try to get around anything that protects it.
• We may change, pause, or shut down any part of the site at any time.

Orders and payment

Online orders are placed through Shopify. When you click Add to cart and check out, you are in Shopify's checkout, and Shopify's customer privacy policy covers what Shopify does with your details there. The sale itself is between you and us, under these terms.

• Prices are in US dollars and can change without notice. The price you pay is the one shown at checkout. Sales tax is added where the law requires it.
• An order is accepted when we ship it. Until then we can cancel it, for example if a product is out of stock, a price or listing was wrong, or we suspect fraud. If we cancel, you get a full refund.
• Pack sizes and what is in a can are described on the Shop page. The label on the can controls if anything on the site is out of date.

Shipping

• We ship within the United States only. If checkout accepts an address outside the US, we will cancel that order and refund it in full.
• Orders usually leave us within three business days. Carrier transit time is on top of that and varies by destination.
• If we cannot ship within that time we will tell you the new date, and you can cancel for a full refund. Under no circumstances will we hold an order more than 30 days without your say-so.
• If a package never arrives, or arrives damaged, email us within 14 days of the expected delivery date and we will replace it or refund you.

Returns and refunds

VYRE is a food product, so we cannot take back cans once they have shipped. That said, we stand behind every order:

• If cans arrive damaged, leaking, past their date, or the order is wrong or short, email us within 14 days of delivery with a photo. We will send replacements or refund the affected items, your choice.
• We issue refunds within 7 business days of agreeing to one. They go back to the original payment method through Shopify, and your bank may take a further few days to show them.
• To cancel an order that has not shipped yet, email us as soon as you can. If it has already left, the rules above apply.

Caffeine and responsible use

Each can contains 115 mg of caffeine. VYRE is not recommended for children, people who are pregnant or nursing, or anyone sensitive to caffeine. It is a beverage, not a supplement or a medicine, and nothing on this site is health advice. If you have a medical condition or take medication, ask your doctor before drinking caffeinated products.

If you choose to drink alcohol, know that caffeine does not reduce alcohol's effects or make you sober. Drink responsibly and never drive after drinking.

Ambassador program

• Sending an application does not make you an ambassador. If we invite you to join, the details, including anything you receive from us, will be set out in a separate agreement.
• Ambassadors are paid or receive free product, so when you post about VYRE you must make that relationship clear, every time, where people will actually see it: at the start of the caption or spoken in the video, not buried in a hashtag pile. “#ad”, “#VYREpartner”, “VYRE pays me” or the platform's paid-partnership label all work; “#ambassador” on its own does not. This is required by the Federal Trade Commission's Endorsement Guides.
• Say only what you honestly think, and do not make claims about VYRE that the label and this site do not make. In particular: no claims about health, hangovers, or how VYRE affects alcohol; no content showing VYRE mixed with alcohol or anyone under 21 drinking; nothing aimed at people under 18.
• We will give you these rules in writing, look at what you post, and ask you to fix or take down anything that breaks them. Repeated problems end the arrangement.

What you send us

When you submit a form, tag us, or send us a message, photo, or idea, you are telling us we can use it to reply to you, evaluate you for the ambassador program, and, for public posts that tag or mention VYRE, share it on our own channels with credit. If a photo shows other people, we will ask before reposting it, and when we repost an ambassador's content we label the relationship too. Do not send us anything confidential or anything you do not have the right to share.

Our brand and content

VYRE™ is a trademark of VYBE Energy Drinks LLC. The VYRE name, wordmark, can design, photos, videos, and copy on this site belong to VYBE Energy Drinks LLC or are used with permission. You can share links and screenshots; you cannot use our name, logo, or images to sell things, imply we endorse you, or build something that looks like us without written permission.

Other services

The site relies on Shopify for checkout, Netlify for hosting and forms, Google for analytics and fonts, and OpenStreetMap and unpkg for the map on the Shop page, and links out to Instagram, TikTok, and Google Maps. Those services have their own terms and we are not responsible for them. Our privacy policy says what each one receives.

No guarantees about the site

We work to keep the site accurate and running, but it is provided as is. We do not promise it will always be available or error-free, and we can correct mistakes, including in prices and descriptions, at any time.

Limits on our liability

To the fullest extent the law allows, VYBE Energy Drinks LLC is not liable for indirect, incidental, or consequential losses arising from the site or an order, and our total liability for any order is limited to what you paid for it. Nothing here limits liability that cannot be limited under the law of your state, and some states do not allow these limits, so they may not apply to you.

Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. If something goes wrong, email us first and we will try to sort it out. If we cannot, any dispute will be brought in the state or federal courts located in Alachua County, Florida, and you agree to that venue.

The product itself

VYRE is sold as described on the can. If what arrives is damaged, wrong, or not what the label says, the Returns section above is how we make it right.

If part of this does not hold up

If a court finds any part of these terms unenforceable, the rest still applies. These terms and our privacy policy are the whole agreement between you and us about the site and online orders; anything we agree separately with wholesale accounts or ambassadors is in writing with them.

Changes

If these terms change we will update the date at the top. Using the site after that means you accept the new version. Orders are governed by the terms in force when you placed them.
